Terms of Service

1. The Service

QA by AI provides an AI-assisted platform that helps software teams automate and manage quality-assurance (QA) testing workflows.

The Service may include web applications, APIs, integrations, and related tools. QA by AI does not process or execute customer source code on its own servers; all testing activity remains within the customer's chosen environment.

We may modify or discontinue features from time to time to improve the Service.

2. Accounts and Access

• The Service is available only to business users. Each account must be registered under a valid business email.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
• You must ensure that only authorized employees or contractors of your organization use the Service in compliance with these Terms.

3. Subscriptions and Payments

• Access to the Service is provided on a subscription basis, billed monthly or annually as selected at checkout.
• All fees are stated exclusive of taxes, which are the Customer's responsibility.
• Subscriptions automatically renew at the end of each term unless cancelled before renewal.
• Payments are processed through third-party payment providers.
• Refunds are not provided except where required by law or expressly stated in a written agreement.

4. Acceptable Use

You agree not to:

1. Copy, modify, reverse-engineer, or attempt to extract the source code of any part of the Service.
2. Use the Service to violate any law or infringe any third-party rights.
3. Access or attempt to access other users' data or interfere with Service operations.
4. Resell, lease, or sublicense the Service without written consent.
5. Use the Service to scrape, crawl, or extract data from any third-party website or application without explicit authorization.

We reserve the right to suspend or terminate accounts engaged in abusive or prohibited behavior.

5. Intellectual Property

• All rights, title, and interest in and to the Service—including software, design, trademarks, and content—belong to QA by AI Pvt. Ltd. or its licensors.
• You retain ownership of all data, configurations, and test results you input or generate through the Service.
• You grant QA by AI a limited, non-exclusive license to host and process such data solely for providing and improving the Service.

6. Confidentiality

Each party may receive confidential information from the other. Both agree to protect such information with reasonable care and to use it only for purposes related to these Terms.

Confidential information does not include information that is publicly available, independently developed, or rightfully received from a third party without restriction.

7. Data Privacy and Security

QA by AI uses industry-standard administrative and technical safeguards to protect data stored on its systems.

We do not process customer source code or production data by default.

Our privacy practices are described in the Privacy Policy, which forms part of these Terms.

8. Service Availability and Changes

We aim to maintain high availability but do not guarantee uninterrupted access.

From time to time, we may modify, suspend, or discontinue parts of the Service for maintenance or other reasons.

Where feasible, we will provide advance notice of material changes.

9. Termination

• You may cancel your subscription at any time through your account settings.
• We may suspend or terminate access for violation of these Terms, non-payment, or other legitimate reasons.
• Upon termination, your access to the Service will cease, and we may delete your account data after a reasonable retention period.

10. Warranties and Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind.

QA by AI does not warrant that the Service will be error-free, secure, or uninterrupted, or that any AI-generated outputs will meet specific requirements or produce particular results.

11. Limitation of Liability

To the maximum extent permitted by law:

• QA by AI's total liability arising out of or related to these Terms shall not exceed the total fees paid by you to QA by AI during the twelve (12) months preceding the claim.
• QA by AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

12. Indemnification

You agree to defend, indemnify, and hold harmless QA by AI, its officers, employees, and agents from any claims, liabilities, damages, or expenses arising from your misuse of the Service, violation of these Terms, or infringement of any rights of a third party.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed under the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Punjab, India.

QA by AI may, at its discretion, opt for binding arbitration in Punjab, India, under the Arbitration and Conciliation Act, 1996.

14. Updates to Terms

We may revise these Terms from time to time. The latest version will always be posted on this page with an updated date.

Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
